Last Updated: 26 November 2024 | Effective Date: 26 November 2024

1. Introduction

Welcome to AHAI (accessible at ahai.co.uk).

These Terms of Service ("Terms") govern your use of our website, our online diagnostic tools (including the "Shadow AI" and "Data Risk" scorecards), and any content or resources available therein.

By accessing or using this website, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the website.

AHAI is the trading name of Alex Harvey ("we", "us", or "our"), located in Kent, United Kingdom.

2. Intellectual Property Rights

Unless otherwise stated, AHAI and/or its licensors own the intellectual property rights for all material on ahai.co.uk. All intellectual property rights are reserved.

2.1. Protection of AHAI Frameworks

Specific proprietary frameworks mentioned or demonstrated on this site, including but not limited to the P.I.T.C.H. Framework™ and the Safe-Start Protocol, are the intellectual property of AHAI.

You may access this from ahai.co.uk for your own personal or internal organisational use subjected to restrictions set in these terms.

You must not:

  • Republish material from ahai.co.uk.
  • Sell, rent, or sub-license material from ahai.co.uk.
  • Reproduce, duplicate, or copy material from ahai.co.uk (including training guides or policy templates) for commercial resale.
  • Redistribute content from AHAI (unless content is specifically made for redistribution, such as a press kit).

3. Use of Diagnostic Tools (Scorecards & Quizzes)

Our website features automated diagnostic tools (e.g., The Shadow AI Scorecard, The Business Data Risk Calculator).

3.1. Indicative Nature

The results, scores, and "Red/Amber/Green" risk ratings provided by these tools are indicative only. They are generated based on the limited information you provide and automated logic. They do not constitute a forensic audit, legal advice, or a formal safeguarding inspection.

3.2. No Liability for Decisions

AHAI is not liable for any business, safeguarding, or policy decisions you make based solely on the results of these free online tools. For a comprehensive assessment of your risk, you must engage us for a formal Tier 1 Audit Service.

4. Disclaimer & Liability Shield

4.1. General Disclaimer

The information provided on this website (including blog posts, guides, and white papers) is for general informational purposes only. While we strive to keep the information up to date and correct, we make no representations or warranties of any kind about the completeness, accuracy, reliability, or suitability of the information.

4.2. Professional Advice Disclaimer

  • Not Legal Advice: We provide technical configuration advice for Google Workspace. We do not provide legal counsel regarding GDPR, UK Data Protection Act 2018, or other statutes. You should consult your Data Protection Officer (DPO) or legal team for compliance verification.
  • Not Safeguarding Assurance: For Education clients, our advice regarding "Age-Gating" and "Walled Gardens" refers to technical infrastructure configuration. We do not monitor user content or guarantee the prevention of all safeguarding incidents.

4.3. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AHAI be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this website.

5. Links to Third-Party Websites

Our Service may contain links to third-party web sites or services (such as Google Workspace, Calendly, or Typeform) that are not owned or controlled by AHAI.

AHAI has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that AHAI shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of such content or services.

6. User Conduct

You agree not to use the website or our enquiry forms to:

  • Transmit any unsolicited or unauthorised advertising ("spam").
  • Transmit any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.
  • Attempt to gain unauthorised access to our web hosting infrastructure (Firebase/GCP).

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
